(2)WINDHILL: Refers to BEIJING WINDHILL TECHNOLOGIES CO., LTD., the operator and service provider of this Website. 

(3)This Website: Refers to the official website of WINDHILL (with the domain name subject to WINDHILL’s official announcement), which focuses on displaying corporate and product information and has no online transaction functions. 

(4)Users: Refers to all natural persons, legal persons, or other organizations that access, browse, or use this Website.

2.Nature of the Agreement 

(1)These Terms constitute a legally binding written agreement between WINDHILL and Users regarding the use of the Website, and supersede any prior oral or written agreements reached by both parties on relevant matters. 

(2)Regardless of whether Users have read these Terms, accessing any page of this Website shall be deemed as full understanding and acceptance of all contents of these Terms; if a User does not agree to these Terms, they shall immediately cease accessing and using the Website

1.WINDHILL reserves the right to modify the contents of these Terms based on revisions to laws and regulations, adjustments to regulatory requirements, business development needs, and other circumstances at any time.

2.The revised Terms shall be publicly posted in a prominent position on the homepage of this Website, and shall automatically take effect 7 natural days after the date of publication (except for urgent changes, which shall be publicly posted and take effect immediately).

3. 2.Special Assistance Services 

(1) Users may submit consultation requests and request detailed materials through the reserved channels on the Website, and WINDHILL shall respond within 3 business days; 

(2) Providing download services for product-related technical documents (such as white papers and solutions) (some documents may be provided only after verification of legitimate use purposes).

3. Service Provision Methods

 (1) All services of this Website are provided online via the Internet; Users shall prepare their own terminal devices and network services that meet the access requirements; 

(2) All services are provided free of charge; WINDHILL shall not charge any fees to Users for the services stipulated in these Terms.


Ⅱ.Service Operation and Restrictions 

1.Service Maintenance and Interruption 

(1) WINDHILL shall perform regular technical maintenance and system upgrades on the Website, and shall issue an announcement on the homepage of the Website at least 24 hours in advance, specifying the maintenance period and scope of impact;

 (2) In case of emergency situations such as sudden technical failures, cyber attacks, and policy regulatory requirements, WINDHILL may temporarily interrupt services; after the interruption, WINDHILL shall promptly issue an explanation and restore services as soon as possible.

2. Restrictions on Service Use

 (1) Users shall access this Website through regular browsers and legal network channels, and shall not use special tools or illegal means to bypass access restrictions; 

(2) Without WINDHILL’s written permission, Users shall not conduct batch crawling, mirror storage, or commercial reuse of the Website’s contents;

Ⅳ.Infringement Complaints and Handling Mechanism

1.If a third party believes that the Website’s contents infringe its intellectual property rights, it may send written complaint materials to WINDHILL, which shall include:

(1)The complainant’s identity certificate (copy of the natural person’s ID card, copy of the legal person’s business license);

(2)Force majeure (including but not limited to natural disasters, wars, government orders, power outages, etc.);

2.WINDHILL shall not be liable for compensation for service suspension during Website maintenance or upgrades, and does not guarantee that all technical failures can be completely repaired.


Ⅲ.Disclaimer for Third-Party-Related Risks

Ⅳ.Liability Limitation Clause

1.WINDHILL collects User information in accordance with the principle of "minimum necessity", and only collects content necessary for providing services: 

(1)Scenarios without proactive submission: No personal information of Users shall be collected;

(2)Scenarios of consultation or information request: Collecting necessary communication information of Users, such as name, contact details, and organizational name;

(3)Other scenarios required by laws and regulations.

2.All information collection activities are based on the User’s proactive provision; no information shall be obtained by force through technical means.


Ⅱ.Specifications for Information Use and Storage

1.The collected personal information shall only be used for the following purposes:

(1)Responding to User consultations and sending requested materials; 

(2)Improving service quality (such as statistics on hot consultation topics and optimizing the response mechanism);

(3)Other purposes required by laws and regulations.

2.Information storage shall adopt security measures such as encrypted storage and access permission control to prevent information leakage, tampering, or abuse; the storage period shall be 1 year after the end of the service, and the information shall be deleted or anonymized in accordance with the law after the expiration.

Ⅲ.xercise of Users’ Information Rights

(1)Sending an email to info@windhilltech.com, with the email subject marked as "Application for Personal Information Processing - [Inquiry/Correction/Deletion]";

(2)Providing at least two items of identity verification information (such as consultation time, email address for receiving materials, reserved mobile phone number, etc.);

(3)Clearly stating the information content to be processed and the request.

2.WINDHILL shall complete the verification and processing within 15 business days after receiving the application; for complex cases, the period may be extended to 30 business days, and the result shall be fed back to the User.

3.Users may withdraw their consent to information processing at any time; after withdrawal, WINDHILL shall stop using the relevant information, but this shall not affect the legality of information processing conducted based on prior consent.


Ⅳ.Information Security and Leakage Handling

1.WINDHILL has established a sound information security management system, equipped with professional technical protection equipment, and conducts regular security audits.

2. In case of a personal information leakage or other security incidents, WINDHILL shall immediately activate the emergency response plan, take remedial measures, and notify the affected Users via email or SMS within 72 hours.


Export Control (if applicable)

1.If this Website contains contents subject to export control, such as technical parameters and software documents, Users shall strictly comply with the Export Control Law of the People's Republic of China and the export control laws and regulations of relevant countries/regions such as the European Union and the United States.

2.Users are prohibited from using the controlled contents for prohibited purposes such as military use, nuclear proliferation, and weapons development, and from providing relevant contents to organizations or individuals listed on international sanctions lists.

3. Change, Suspension and Termination of Services

Ⅰ. Service Change

1.WINDHILL may adjust the service contents based on business development, including adding new functions, optimizing existing services, or suspending some non-core services; WINDHILL shall notify Users through a Website announcement before the adjustment.

2.Service changes shall not affect the core rights of Users under these Terms; if the change results in a significant decline in service quality, Users may cease using the service and request an explanation.


Ⅱ. Service Suspension and Termination

1.WINDHILL may suspend services to a User under the following circumstances: 

(1)The User violates the provisions of these Terms and fails to correct the violation within the specified period after being notified; 

(2)Necessary technical maintenance or system upgrades are conducted;

(3)Temporary control measures are required by laws and regulations.

2.WINDHILL may terminate services without liability under the following circumstances:

(1)The User seriously violates these Terms and infringes on the legitimate rights and interests of WINDHILL or a third party;

(2)The Website ceases operation due to policy adjustments, business transformation, etc., and an announcement has been issued 30 days in advance; 

(3)The User uses the service through improper means such as fraud or coercion.

3. After service termination, WINDHILL shall stop collecting User information, delete or anonymize the collected personal information in accordance with regulations, and terminate the User’s right to use the Website’s contents.


Liability for Breach of Contract

Ⅰ.User Breach Scenarios and Liabilities

1.If a User breaches the provisions of these Terms, WINDHILL has the right to take the following measures: 

(1)Issuing a written warning and requiring correction within a specified period; 

(2)Restricting or prohibiting the User’s access to the Website;

(3)Deleting the non-compliant content or canceling the provided special services; 

(4)Pursuing legal liabilities.

2.If the User’s breach causes losses to WINDHILL (including direct economic losses, attorney fees, litigation fees, notarization fees, and other rights protection costs), WINDHILL has the right to request full compensation from the User.

3.If multiple Users jointly commit a breach, they shall bear joint and several liability.


Ⅱ.WINDHILL’s Breach Scenarios and Liabilities

1.If WINDHILL breaches the provisions of these Terms and causes damage to the legitimate rights and interests of a User, WINDHILL shall bear corresponding liability for breach of contract, but shall not be liable for indirect losses or expected interest losses.

2. If the breach is caused by force majeure or a third party, WINDHILL shall not be liable, but shall promptly notify the User and take remedial measures.


Dispute Resolution and Applicable Law

Ⅰ.Applicable Law

The formation, effectiveness, performance, interpretation, and dispute resolution of these Terms shall be governed by the laws and regulations of the People's Republic of China, including but not limited to the Civil Code of the People's Republic of China, Copyright Law of the People's Republic of China, Personal Information Protection Law of the People's Republic of China, and Cybersecurity Law of the People's Republic of China (excluding conflict of laws rules).


Ⅱ. Dispute Resolution Methods

1.Any dispute arising from or in connection with these Terms shall first be resolved through friendly negotiation between the parties, with a negotiation period of 30 days.

2.If negotiation fails, either party has the right to file a lawsuit with the people's court with jurisdiction at the place where WINDHILL is located.

3. During the dispute resolution period, the parties shall continue to perform other provisions of these Terms except for the disputed matters.


Miscellaneous

1.The headings in these Terms are for reading convenience only and shall not affect the interpretation or validity of the Terms.

2.If any provision of these Terms is deemed invalid, illegal, or unenforceable by a competent court, such provision shall be deemed deleted from these Terms, but the validity, legality, and enforceability of the remaining provisions shall not be affected

3.WINDHILL’s failure to exercise or delayed exercise of any right under these Terms shall not constitute a waiver of such right; WINDHILL’s exercise of part of its rights shall not affect its exercise of other rights.
